IntelBee — Terms of Service

Contracting entity: Artificial Intelligence Mars SRL, Dr Petre Herescu 12, Bucharest, Romania ("IntelBee", "we", "us", "our").
Applies to: intelbee.com, our APIs, datasets, web apps, and browser extensions/add‑ons (the "Services").
Plain‑English summary (non‑binding): You may use IntelBee to analyse technologies used by websites and to access technographic and business‑contact data, within plan limits. You must comply with privacy/marketing laws when using contact details. IntelBee provides data "as‑is," without warranties; liability is limited; disputes are resolved by [arbitration/courts] under [governing law].
1) Acceptance of the Terms
By creating an account, installing an IntelBee extension, using our APIs, or accessing the Services, you agree to these Terms and our Privacy Policy (together, the "Agreement"). If you use the Services on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" includes that organisation.
2) Eligibility
You must be at least 18 (or the age of legal majority in your jurisdiction). The Services are not for children. You may not use the Services if you are barred under applicable laws or under export/sanctions restrictions.
3) Accounts & Security
Provide accurate registration details and keep credentials confidential. You're responsible for activities under your account. Notify us promptly at [email protected] of any suspected compromise.
4) The Services & Scope
IntelBee offers:
- Technology detection & insights (site "fingerprints," tags, headers, scripts, etc.).
- Datasets & lead lists with company/website attributes and public‑source business contact details (e.g., names, roles, business emails) where allowed by law.
- Browser extensions that identify website technologies and may contribute to telemetry to improve our datasets.
- APIs & exports enabling automated queries and enrichment.
IntelBee may change or discontinue features at any time.
5) Definitions
Customer Data: Data you submit, upload, or provide (including URLs you analyse, lists you import, configurations, and account info).
IntelBee Data: Data made available by IntelBee (e.g., technographic signals, classifications, company metadata, Public‑Source Contact Data, and any Derived Data created from processing or aggregating Customer Data and third‑party/public sources).
Output: Results returned by the Services in response to your queries (e.g., technology stacks, lists, matches).
6) Rights & Ownership
You own your Customer Data. You grant IntelBee a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and use Customer Data and to generate Derived Data to provide, secure, maintain, and improve the Services (including models, heuristics, and detection rules).
IntelBee owns the Services, IntelBee Data, detection rules, models, and all Derived Data (excluding your raw Customer Data). Except for the limited rights granted here, no rights are transferred.
Feedback is voluntary; we may use it without restriction and without attribution or compensation.
7) License & Acceptable Use
Subject to the Agreement and your plan limits, IntelBee grants you a non‑exclusive, non‑transferable, revocable license to access the Services and use IntelBee Data solely for your internal business purposes. Unless permitted in writing:
- No reselling, sublicensing, sharing, or redistributing IntelBee Data, Output, or credentials (including within a data marketplace or to train competing models).
- No scraping or harvesting IntelBee's websites, endpoints, or datasets.
- No competitive use to create a dataset or service that is substantially similar to or competes with IntelBee.
- No circumvention of technical controls, rate limits, or access restrictions; no reverse engineering of detection logic or proprietary models.
- No illegal, harmful, or infringing use, including violating site terms, privacy laws, or sending unsolicited or unlawful communications.
- No profiling of individuals for decisions with legal or similarly significant effects, or any FCRA/credit‑, employment‑, housing‑, or insurance‑eligibility purposes.
8) Marketing & Privacy Compliance (Critical)
If you use Public‑Source Contact Data or any emails discovered via our Services:
You are solely responsible for compliance with all applicable marketing, privacy, and anti‑spam laws (e.g., CAN‑SPAM, CASL, UK PECR, EU ePrivacy, GDPR legitimate‑interest tests, local "do‑not‑call" or "do‑not‑email" rules).
You must maintain an opt‑out mechanism and honour suppression lists. Do not contact individuals in ways that are deceptive, unfair, or outside reasonable B2B expectations.
Jurisdictional restrictions: We may restrict access to contact data for specific regions to comply with local law. We may remove or obfuscate data or require additional diligence from you to continue access.
9) API & Extension Terms
API keys are personal to your organisation and must be kept confidential. You're responsible for all usage under your keys. Usage may be metered; overages incur fees.
Rate limits and fair‑use policies apply; IntelBee may throttle or suspend abusive or excessive usage.
Browser extensions: The extension analyses the active page and may transmit URLs, domains, and relevant technical signals to IntelBee to perform detection, improve quality, and prevent abuse. We instruct our extensions not to collect form fields or credentials and to minimise personal data, but you are responsible for deploying them lawfully within your organisation (see Privacy Policy).
10) Third‑Party Services
The Services may interoperate with third‑party tools (cloud hosts, analytics, payment processors, etc.). IntelBee is not responsible for third‑party terms or practices. Your use of third‑party services is governed by their terms.
11) Plans, Fees, Trials, Taxes and Refunds
Paid features require a subscription or consumption‑based fees. Subscriptions auto‑renew unless cancelled per your plan terms. You authorise IntelBee (or its processor) to charge fees, taxes, and overages. Fees are non‑refundable except as required by law or expressly stated. We may change pricing on notice for future terms.
You may request a refund only if the subscription fee has been paid and no lead lists have been exported during the billing period.
12) Confidentiality
"Confidential Information" means non‑public information disclosed by one party to the other that is marked or reasonably understood as confidential. Each party will protect the other's Confidential Information with reasonable care and use it only to perform under this Agreement.
13) Data Protection; DPA
IntelBee will implement reasonable technical and organisational measures to protect personal data. Where IntelBee processes personal data on your behalf, the Data Processing Addendum (DPA) at [https://intelbee.com/dpa] (or as otherwise provided) applies and is incorporated by reference.
14) Security; Acceptable Research
Do not probe or test the security of the Services without our prior written authorisation. Report issues promptly to [email protected].
15) Service Changes; Availability
We may modify, discontinue, or deprecate features (including datasets and endpoints). We aim for high availability but provide no uptime guarantee unless a separate SLA is in place.
16) Publicity
Unless you opt out in writing, IntelBee may use your name and logo to identify you as a customer.
17) Term; Suspension; Termination
This Agreement continues until terminated. We may suspend or terminate access immediately for breach, risk, or legal compliance. You may terminate by cancelling your account and ceasing use. Upon termination, your license ends, and you must stop using IntelBee Data; sections that by nature should survive (ownership, confidentiality, payment, disclaimers, limits, dispute resolution) survive. We may provide limited data export upon request, where feasible.
18) Disclaimers
THE SERVICES, OUTPUT, AND INTELBEE DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." INTELBEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, NON‑INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. Detected technologies, metadata, and contact details may be inaccurate, incomplete, or outdated. You rely on Output at your own risk.
19) Indemnification
You will defend, indemnify, and hold harmless IntelBee and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from: (a) your Customer Data or use of Output/IntelBee Data (including communications you send); (b) your violation of this Agreement or laws (including privacy/marketing laws); (c) any use of the Services in a manner that infringes third‑party rights.
20) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NO INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; (b) INTELBEE'S TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO INTELBEE FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (OR USD $100 IF YOU HAVE NOT PAID FEES). Some jurisdictions do not allow certain limits; those limits apply to the extent permitted.
21) Export; Sanctions; Anti‑Corruption
You represent that you are not subject to sanctions and will not use the Services in sanctioned countries or for prohibited end uses. You will comply with anti‑corruption laws and will not offer bribes or improper payments in connection with the Services.
22) IP Complaints; DMCA
If you believe content infringes your rights, send a notice to our DMCA Agent: [email protected]. Include the elements required by 17 U.S.C. §512(c)(3). We may remove content or disable access at our discretion.
23) Governing Law & Dispute Resolution
Courts (non‑arbitration): This Agreement is governed by the laws of Romania, and the courts of Romania have exclusive jurisdiction.
Where consumer law mandates, you retain any non‑waivable rights.
24) Changes to these Terms
We may update these Terms by posting a revised version with a new "Last updated" date. Material changes will be notified via the Services or email. Continued use after changes means acceptance.
25) Miscellaneous
Entire agreement; no waiver by delay; severability; assignment only with our consent (we may assign to an affiliate or in a reorganisation); force majeure; headings for convenience only; translations are for convenience—English controls.
